When it comes to legally binding documents either for parenting or financial matters, Consent Minutes of Orders are most widely used to record the agreement reached between parties.
Consent Minutes of Order are a binding Court Order, the same type of document parties would ultimately end up with if they had proceedings before the Federal Circuit and Family Court of Australia. The difference with Consent Minutes of Order is that you and the other party have reached an agreement and have chosen the terms of the Order.
Ultimately one party will require a solicitor to assist with drafting the terms of the Order and to submit your Application for Consent Orders which is to accompany Consent Minutes of Order to be filed in the Federal Circuit and Family Court of Australia for sealing by a Registrar of the Court.
As the Family Law Act is a federal Act, the same legislation applies throughout Australia and therefore Awkar & Co can assist clients in all states and territories. This does not apply to Western Australia as they do have their own Act that they are governed by.
